Whether Zhukovskyy was impaired at the time of the crash is a critical detail in the trial. Prosecutors called forensic toxicologist Donna Papsun to testify about the original lab results on Zhukovskyy’s blood.

Papsun said the lab found levels of opiates below the normal reporting level but said the drugs could affect the ability of a person to operate a motor vehicle.

The defense questioned whether those low levels could have been a factor in the crash. Papsun tested investigators have to take into account the totality of the circumstances of a crash to determine whether impairment was a factor.

A firefighter who said he treated Zhukovskyy for a heroin overdose in Massachusetts one month before the Randolph crash also took the stand. Firefighter Paul Novisky described the symptoms he saw.

“Blue around his lips and his face,” Novisky said. “His pupils were pinpoint. He was unresponsive to verbal stimuli at that time.”

Testimony is scheduled to resume at 9 am Tuesday.
